What is Adjustment of Status?
Adjustment of Status is the process that allows eligible spouses already living in the U.S. to apply for a green card without leaving the country. Instead of consular processing abroad, you stay here while the case is pending — and you can apply for a work permit and advance parole travel document.

Quick rules
- Must be physically in the U.S. at the time of filing.
- Generally requires a lawful entry (e.g., admission with a visa or parole).
- Married to a U.S. citizen (or, in some cases, a permanent resident) with no bars to adjustment.
- Green card validity: 2‑year (conditional) if marriage under 2 years at approval; otherwise 10‑year.
